Contractual Terms between Coven and the Final Consumer

1. Subject
1.1 - The general terms of sale published here govern the sales contract (hereinafter, for brevity, the "Contract") to users of the website (hereinafter, for brevity, the "Buyers" or the "Buyer") through online means for the purchase of goods (hereinafter, for brevity, the "Product" or the "Products") displayed on the website www.covennlux.com.

1.2 - The General Terms of Sale published on the Website must be viewed and understood by the Buyer before making a purchase. By sending the purchase order, the Buyer declares to have viewed and accepted these terms, and consequently, the order cannot be canceled thereafter.

1.3 - The Buyers will also benefit from the protections provided in the case of concluding distance contracts according to Title III, Section II, of Legislative Decree No. 206 of 6 September 2005 ("Consumer Code"), as well as all other protections unavoidably provided in favor of the Buyers by the Consumer Code itself [http://www.codicedelconsumo.it/].

1.4 - The sections “Orders and Shipments,” “Returns and Refunds,” and “Payment Methods” present on the Website must be considered an integral and substantial part of these General Terms of Sale.

2. Conclusion of the Contract
2.1 - To proceed with the purchase of the Products, the Buyer must submit the purchase order and make the payment, following the procedures indicated in the relevant sections.

2.2 - In particular, the steps to proceed with the purchase are as follows:

  • The Buyer may freely access the Website and view the essential characteristics of the displayed Products, including the price, as well as the images published to illustrate the Products.

  • The Buyer can select one or more Products they wish to purchase, adding them to a virtual "cart." The contents of the cart can always be viewed by the Buyer before proceeding with the order submission. Furthermore, by accessing the cart, the Buyer will be able to see all relevant information about the purchase, including shipping costs and expected delivery times, before making the purchase.

  • To complete the purchase, the Buyer must register on the Website, providing their email address, a preferred password (which will allow access to the Website), and a mobile number for electronic invoicing and customer registration—or it is possible to finalize the purchase as a "Guest."

  • Once the purchase is finalized, after accepting the conditions, the order cannot be canceled.

  • To complete the order, the Buyer must also enter the shipping address and payment details in the "cart" section.

  • The Buyer can modify the selected Products and entered details until finalizing the order by selecting the "Payment" button.

  • Coven does not deliver to P.O. Boxes.

2.3 - The Buyer may make payment via credit/debit cards, bank transfer, or installment payments. More detailed information regarding payment methods is available in the "Payment Methods" section of the Website.

2.4 - Upon receiving the purchase order, Coven will send a confirmation receipt to the Buyer’s email address containing a summary of the purchase information. Once the purchase is processed, the order will be fulfilled. The order will be considered accepted, and the Contract concluded when the Buyer finalizes the purchase.

2.5 - The contract will be stored as a PDF and sent via the aforementioned email and electronically archived by Coven.

3. Rights and Obligations Between the Parties
3.1 - Coven will deliver the Products to the address provided by the Buyer in the purchase order, via a carrier appointed specifically for this purpose. More detailed information regarding shipping times and locations is available in the “Orders and Shipments” section of the Website.

3.2 - Coven assumes no responsibility for any errors in delivery due to inaccuracies or omissions in the purchase order completed by the Buyer or any damage to the Products occurring after delivery to the carrier, nor for delays in delivery caused by the carrier or due to weather conditions, customs issues, or other circumstances beyond Coven's control.

3.3 - If one or more Products are unavailable, Coven will notify the Customer by sending an email to the address provided during registration on the Website. In this case, Coven will refund the Customer via the payment card or account indicated for the purchase, the price and, if the purchase only concerned the unavailable Product, the shipping costs. If the Buyer agrees, Coven may send a different Product of equivalent value.

3.4 - If designers decide to make changes during production and/or not produce one or more products, or if a pre-ordered product is not delivered by the designer, Coven will contact the customer to request express approval and either proceed with shipping or cancel the order and provide a refund.

3.5 - In any case, the unavailability of one or more ordered Products cannot be grounds for canceling the entire order by the Buyer.

3.6 - Upon delivery of the Products by the appointed carrier, the Buyer must verify in the presence of the carrier:

  • That the packaging used for transportation is intact, undamaged, or altered, even in the sealing materials;

  • That the quantity and type of the Products ordered match what is indicated in the shipping document and the order.

3.7 - If the Buyer notices any discrepancies or defects, they must immediately inform the carrier at the time of delivery.

3.8 - The Buyer is solely responsible for the accuracy and correctness of the information and data provided to Coven and agrees to promptly notify any changes to previously provided data.

4. Product Conformity
4.1 - Coven strives to ensure that the description and/or photographic representation of the Products on the Website is as accurate as possible. However, since image quality may depend on the devices used by the Buyer, it is possible that the Buyer’s perception of the description or photographic representation of the Products may not exactly match the Product itself, so the images and videos accompanying the presentation of the Products are to be considered purely descriptive.

4.2 - If the delivered Product is found to be defective or different from what was ordered, Coven will provide the Customer with a legal warranty of conformity, in accordance with Articles 128 and following of Legislative Decree No. 206/2005. In particular, the Buyer will have the right to request, alternatively:

  • Delivery of a Product of equivalent quality and price, subject to stock availability;

  • A refund of the price of the Product and shipping costs.

4.3 - The warranty described in this article applies only if the Products have been handled with due care and used in accordance with their intended purpose, and the Buyer presents the delivery slip and order number.

4.4 - In any case, the warranty does not apply to defects resulting from normal wear and tear of the Product.

5. Right of Withdrawal
5.1 - In accordance with the provisions of the Consumer Code, the Buyer has the right to withdraw from the Contract without penalty and without providing any reason, starting from the receipt of the order confirmation sent by Coven and within 14 days from the receipt of the Product.

5.2 - To exercise this right of withdrawal, the Buyer must send a specific communication to Coven within the aforementioned 14-day period from the delivery date of the Product.

5.3 - In the event of exercising the right of withdrawal, the Buyer will also be required to return the Product to Coven within 3 days from sending the aforementioned communication.

5.4 - The customer can return one or more items from the bag department. After the goods are returned, they may request Store Credit or a refund, excluding shipping costs.

5.5 - A condition for exercising the right of withdrawal is that the product to be returned is substantially intact. It is sufficient for the Product to be returned in normal condition, as long as it has been stored and handled with ordinary care.

5.6 - Specifically, the goods must be returned:

  • Properly packaged in their original packaging and double-boxed, in perfect condition (not damaged, soiled, or altered) and with all accessories and documentation;

  • With the transport document (included in the original packaging) so that Coven can identify the Buyer (order number, name, surname, and address);

  • Without obvious signs of use, other than those compatible with a normal trial of the item. The item should not show prolonged use (beyond a few minutes) or be in a condition that would prevent resale;

  • Coven’s warranty seals, if present, must not be removed or tampered with.

5.7 - The return shipping costs will be borne by the Buyer, as specified in the "Returns and Refunds" section of the Website.

5.8 - After the Buyer exercises the right of withdrawal in accordance with these General Terms of Sale, Coven will return the Customer a credit to use or a monetary refund (excluding shipping costs).

5.9 - The right of withdrawal, in any case, will not apply to the following Products:

  • Personalized or used goods that, by their nature, cannot be returned or are at risk of deteriorating or altering quickly.

6. Protection of Personal Data
6.1 - Coven is committed to respecting the confidentiality of personal data collected during registration on the Website and/or provided during the purchase by the Buyer and to processing them in accordance with the regulations of Legislative Decree 196/03.

7. Miscellaneous
7.1 - Coven reserves the right to modify these General Terms of Sale at any time.
